Global Cosmetics Regulatory Update – January 2026

In January 2026, several important updates and implementations took effect in global cosmetics regulations, covering ingredient bans, labeling requirements, import testing, and safety assessments.
France: Comprehensive PFAS Ban (Effective January 1, 2026)
France enacted Law No. 2025-188, stipulating that from January 1, 2026, the manufacture, import, and sale of consumer products containing PFAS (per- and polyfluoroalkyl substances), including cosmetics, wax products, textiles, footwear, and water repellents, are prohibited (with some specific exemptions).
This is among the earliest nationwide laws in the world imposing a comprehensive PFAS ban in cosmetics.

Indonesia: Mandatory Testing for Cosmetics Import Permits (Effective January 8, 2026)
The Indonesian National Agency of Drug and Food Control (BPOM) issued Resolution No. 627/2025, effective January 8, 2026:
• Applicants for border import permits (SKI Border) must submit Certificates of Analysis (COA)
• COA must include microbiological and heavy metal tests (e.g., lead, mercury)
• COA is valid for one year; additional proof may be required for different import batches
This regulation strengthens import compliance requirements for cosmetics.
EU SCCS: Preliminary Safety Assessment of Micronized Silver Particles
On December 18, 2025, the Scientific Committee on Consumer Safety (SCCS) released a draft opinion on the use of micronized silver particles in cosmetics. The public consultation period is open until February 23, 2026. The assessment focuses on skin penetration and the determination of safe concentration levels for silver particles.
New Zealand: New Cosmetics Regulatory Rules (Effective January 1, 2026)
New Zealand revised its cosmetic standards, establishing transition periods and specific requirements:
• From January 1, 2026, all imported and manufactured cosmetics must comply with the new rules
• Cosmetics containing PFAS will be prohibited from import or manufacture starting in 2027
• Certain ingredients, such as UV filters, are subject to phased restrictions over time
The new rules emphasize product compliance and provide a clear timeline for ingredient restrictions.
New Jersey, USA: PFAS Cosmetic Ban (Effective January 12, 2028)
The New Jersey Senate passed the Protecting Against Forever Chemicals Act (S1221), which stipulates:
• From January 12, 2028, the sale of cosmetics intentionally containing PFAS is prohibited
• The ban applies to the sale, distribution, and provision of such cosmetics
This represents a clear state-level restriction on PFAS in cosmetics in the U.S.
Switzerland: Furocoumarins Phototoxicity Limits (Effective January 1, 2026)
Switzerland revised its Cosmetics Ordinance, setting cumulative concentration limits for certain furocoumarins (e.g., 5-Methoxypsoralen) in products exposed to sunlight. Most skin-exposed products must not exceed 1 mg/kg.
Summary:
January 2026 reflects global trends in cosmetics regulation, including stricter ingredient safety, enhanced import and labeling compliance, and ongoing international safety assessments. Companies should closely monitor regulation effective dates and detailed requirements, in order to adjust formulations, labeling, and supply chain compliance strategies, thereby ensuring smooth market access.
